TERMS AND CONDITIONS

Definitions

In these Terms and Conditions:

  • “We”, “our”, “us” refer to Kayak-King Pembrokeshire LTD / Sea Kayak Academy and our staff.

  • “Customer” refers to any individual or group making a booking or purchase with us.

  • “Tour” or “Course” refers to any kayaking activity or sea kayaking instructional session provided by us.


1. Bookings

A booking is confirmed once full payment is received and we send written confirmation.

Payment can be made by debit or credit card.
Making payment indicates acceptance of these Terms and Conditions.


2. Changes by the Customer

If you need to amend your booking, contact us as soon as possible.

  • Changes to group size must be agreed in advance.

  • If your change increases the price, the difference must be paid at the time of the change.

  • If your change reduces the price, no partial refund is provided.

  • We will accommodate changes where reasonably possible.


3. Cancellation by the Customer (60-Day Policy)

  • Cancellation more than 60 days before your booked tour or course:
    You may receive a 50% refund, or request a date transfer (subject to availability).

  • Cancellation 60 days or fewer before the tour/course:
    No refund will be given. Date transfers usually cannot be offered within this period.

  • No-shows, for any reason including illness, injury, or travel disruption, receive no refund.

  • Exceptional circumstances:
    In cases of bereavement, major injury, or other serious unforeseen events, we may offer a discretionary credit or date transfer. Supporting information may be requested.

We strongly recommend taking out travel or trip-cancellation insurance.


4. Cancellation by Kayak-King / Sea Kayak Academy

We may cancel a tour or course due to:

  • Unsafe sea or weather conditions

  • Insufficient bookings

  • Operational or logistical issues

  • Other unforeseen circumstances

If we cancel your booking, you may choose either:

  • A full refund, or

  • A transfer to an alternative date

We are not responsible for costs incurred preparing for your activity (e.g., travel, accommodation).
We will notify you as early as possible if cancellation is likely.


5. Weather

Because our venue is sheltered, most sessions run in variable weather.
If conditions are unsafe or unsuitable:

  • A new date will be offered, or

  • A credit note will be issued for the full value of your booking

The guide’s decision on weather and sea conditions is final.


6. Customer Fitness, Medical Disclosure & Risk

  • No prior kayaking experience is required, but a reasonable level of physical fitness is necessary.

  • Customers must disclose any medical conditions, injuries, or medications that may affect participation.

  • We may refuse participation if a condition poses a safety concern.

  • Tours take place in remote coastal areas; evacuation may be slow and/or costly.

  • Participation is at your own risk once fitness is confirmed.

  • We welcome customers with disabilities—please contact us in advance to discuss requirements.


7. Customer Safety

For the safety of all participants:

  • You must follow the instructions of our guides at all times.

  • Failure to follow instructions may result in removal from the activity without refund.

  • Group activities may require balancing different abilities and needs.


8. Customer Belongings

We accept no responsibility for loss or damage to personal belongings, including:

  • Keys

  • Phones

  • Clothing

  • Vehicles

  • Valuables

Items left in our vehicles or facilities are done so at the customer’s own risk.


9. Supervision of Minors

  • We provide instruction only.

  • Adults accompanying minors remain responsible for their safety and behaviour before, during, and after the session, unless under direct instruction.

  • Disruptive behaviour may result in exclusion without refund.

  • Group leaders are responsible for supervision outside activity time.

  • Any damage caused by minors is the responsibility of the supervising adult.


10. Aggressive or Offensive Behaviour

We may exclude any customer whose behaviour is unsafe, abusive, or disruptive.
No refund will be given.
Customers may be liable for any damages caused.


11. Alcohol and Drugs

Customers must not be under the influence of alcohol or drugs.

We may refuse participation or exclude any impaired customer without refund.


12. Changes in Advertised Price

Prices displayed at the time of booking are valid.
Any changes will be shown on the booking page.


13. Gift Vouchers

  • Valid for 12 months from purchase unless otherwise stated.

  • Can be extended once for an additional 12 months for a £20 fee (plus any price increases).

  • Cannot be extended after expiry.

  • Booking is subject to availability and weather.

  • Once a date is confirmed, the voucher is considered used.

  • Vouchers cannot be exchanged for cash.


14. Insurance and Liability

  • We hold public liability insurance up to £5 million.

  • Our tours and courses do not include personal accident, travel, or cancellation insurance.

  • Customers should obtain appropriate insurance cover.


15. Equipment Care and Liability

We supply well-maintained equipment.

Customers must:

  • Use equipment as instructed

  • Handle equipment responsibly

  • Report any damage immediately

Damage caused by negligence, misuse, or reckless behaviour may result in repair or replacement charges.


16. Photographic Release

We may take photos or video during activities for promotional use.

If you do not wish to be photographed, please inform your guide before the activity begins.


17. Intellectual Property

All images, branding, wording, and materials remain the property of Kayak-King Pembrokeshire LTD / Sea Kayak Academy.
No rights are transferred to customers.


18. Data & Privacy

We collect and process personal information to manage bookings and ensure safety.

  • Legal basis: contract fulfilment & legitimate interests

  • Storage: data retained only as long as necessary for operational, insurance, or legal requirements

  • Payment data: we do not store your full card details; these are processed securely by our payment provider

  • Your rights: request access, correction, or deletion of your personal data at any time unless legal requirements prevent deletion

We do not sell or trade customer information.
You can unsubscribe from newsletters at any time by emailing info@seakayakacademy.com.


19. Medical & Liability Forms

All participants must complete the required forms before taking part in the activity.


20. COVID-19

If government guidelines force cancellations, customers will receive a full refund or reschedule option.


21. Tipping

Gratuities are never expected but always appreciated.


Refund & Returns Policy – Retail Shop

(This applies to physical shop items only, not tours or courses.)

1. Returns

We accept returns within 14 days if items are:

  • Unused

  • In original packaging

  • In resellable condition

  • With all tags attached


2. Refunds

Approved returns are refunded to the original payment method.
Shipping costs are non-refundable unless the item was faulty or incorrect.


3. Exchanges

Exchanges are available subject to stock availability.


4. Faulty or Incorrect Items

Please notify us within 7 days of receiving the item and include photos if possible.
We will arrange a replacement or provide a full refund.


5. Non-returnable Items

For hygiene and safety reasons, we cannot accept returns of:

  • Snorkel mouthpieces

  • Used PPE

  • Any item showing signs of wear or use


Governing Law & Severability

These Terms are governed by the laws of England and Wales.
If any clause is deemed unenforceable, the remaining clauses remain fully valid.
